Terms and Conditions

1. Seller Identification

In accordance with Art. 12 of Law no. 284/2004 on electronic commerce, the seller and operator of the online store acoperispentrufiecare.md is:

Hereinafter referred to as the "Seller" or "we". The person placing an order on the site is referred to as the "Buyer" or "Consumer" (when acting for purposes outside their trade or professional activity).

2. Object and Scope

2.1. These Terms and Conditions regulate the distance sale, through the acoperispentrufiecare.md website, of roofing materials and related products (metal tiles, corrugated sheets, drainage systems, accessories, construction materials, etc.), with delivery within the territory of the Republic of Moldova.

2.2. Placing an order on the site implies acceptance of these Terms and Conditions, the Delivery and Payment Policy, and the Right of Withdrawal and Return Policy, which are an integral part of the contract.

2.3. Contracts concluded through the site are distance contracts within the meaning of Art. 1014 of the Civil Code of the Republic of Moldova no. 1107/2002 (republished), and the provisions of Art. 1013–1023 and 1052–1065 of the Civil Code apply to them.

3. Capacity to Contract

3.1. Orders may be placed by natural persons who have reached the age of 14 and have the necessary capacity to act according to the Civil Code, as well as by legal entities through their authorized representatives. Minors between 14 and 18 years of age may contract only within the limits provided by law or with the consent of their legal representative.

3.2. By placing the order, the Buyer confirms that the provided data is correct and complete.

4. Pre-contractual Information

4.1. Before placing the order, the Seller provides the Consumer, in Romanian, with the information provided for in Art. 1015 para. (1) of the Civil Code, including: essential characteristics of the goods; identity of the Seller (name, IDNO, address, phone, e-mail); total price, including all taxes and duties, as well as delivery costs; payment, delivery, and execution methods; delivery time; complaint handling procedure; existence, conditions, duration, and procedure for exercising the right of withdrawal, together with the withdrawal form, as well as cases where the right of withdrawal does not exist; bearing of return costs; existence of the legal guarantee of conformity and, where applicable, commercial guarantees and after-sales services; possibility of resorting to alternative dispute resolution mechanisms.

4.2. This information can be found on product pages, in these Terms and Conditions, on the "Delivery and Payment" page, and on the "Right of Withdrawal and Return" page, and becomes an integral part of the contract (Art. 1015 para. (5) of the Civil Code).

4.3. Delivery restrictions and accepted payment methods are indicated no later than the beginning of the order placement process (Art. 1017 para. (5) of the Civil Code).

5. Order Placement and Contract Conclusion

5.1. The order is placed by adding products to the cart and following the checkout steps. Before confirmation, the Buyer can check and correct the order content, delivery data, and total price.

5.2. The order completion button is marked to unequivocally indicate the payment obligation ("Order with payment obligation" or an equivalent unequivocal wording), in accordance with Art. 1017 para. (4) of the Civil Code.

5.3. After placing the order, the Buyer receives an order confirmation via e-mail. The contract is considered concluded at the moment of order confirmation by the Seller.

5.4. The Seller sends the Consumer the confirmation of the concluded contract, with all information provided for in Art. 1015 para. (1) of the Civil Code, on a durable medium (e-mail), within a reasonable time after the conclusion of the contract and no later than the time of delivery of the goods (Art. 1017 para. (9) of the Civil Code).

5.5. The Seller may contact the Buyer to clarify order details (cutting dimensions, color, stock availability, access conditions for delivery). For products manufactured or cut to the dimensions indicated by the Buyer, parameters are confirmed in writing (e-mail) before production begins; see also section 8 regarding the lack of the right of withdrawal for such products.

5.6. The Seller may refuse or cancel an order in justified cases (product unavailability, obvious price error, impossibility of confirming contact details), with notification to the Buyer and full refund of amounts already paid.

6. Prices

6.1. Prices are expressed in Moldovan lei (MDL) and include all taxes and duties, including VAT.

6.2. Prices do not include delivery costs. These are calculated based on the order volume and delivery address and are communicated to the Buyer upon order confirmation, before it becomes binding, according to the "Delivery and Payment" page.

6.3. The applicable price is the one displayed on the site at the time of order placement. Promotions are valid within the limits of available stock and the indicated period.

7. Payment Methods

7.1. Accepted payment methods: cash on delivery and bank transfer based on the invoice/payment account. Online card payment will be available later; upon its activation, this section and the Privacy Policy will be updated.

7.2. For payment by bank transfer, the bank details indicated in section 1 are used. The order is processed after the payment is registered, unless the parties have agreed otherwise.

7.3. No additional fees are charged for using a specific payment method.

8. Right of Withdrawal

8.1. The Consumer has the right to withdraw from the distance contract within 14 days from the date of taking physical possession of the goods, without invoking any reason, under the conditions of Art. 1052–1065 of the Civil Code.

8.2. The right of withdrawal does not apply, among others, to goods manufactured or cut according to the Buyer's specifications or clearly personalized (e.g., metal tiles, corrugated sheets, tinsmith elements, or drainage systems cut/manufactured to the dimensions indicated by the Buyer) — Art. 1065 para. (1) lit. c) of the Civil Code, as well as custom-colored paints and other goods which, after delivery, are inseparably mixed with other goods — Art. 1065 para. (1) lit. f) of the Civil Code.

8.3. The complete conditions for exercising the right of withdrawal, the withdrawal form, the list of exceptions, and refund rules are described on the "Right of Withdrawal and Return" page, which is an integral part of these Terms and Conditions.

9. Legal Guarantee of Conformity and Commercial Guarantees

9.1. The Seller is liable to the Consumer for any lack of conformity of the good existing at the time of delivery and which manifests itself within 2 years from delivery, in accordance with Art. 23 of Law no. 105/2003 on consumer protection (republished).

9.2. The lack of conformity found in the first year after delivery is presumed to have existed at the time of delivery, unless this presumption is incompatible with the nature of the good or the lack of conformity.

9.3. The Consumer informs the Seller about the lack of conformity within 2 months from the date of its discovery. The date of purchase is confirmed by the cash receipt, invoice, or any other means of proof admitted by law.

9.4. Remedying the lack of conformity (repair or replacement) is carried out within no more than 14 calendar days from the date the Consumer notified the Seller of the lack of conformity and handed over the good. For goods weighing over 10 kg or with dimensions over 200 cm, transport for repair/replacement is provided by the Seller, at their own expense (Art. 20 of Law no. 105/2003). Refund of the value, when due, is carried out within no more than 14 days.

9.5. In addition to the legal guarantee, some products benefit from manufacturers' commercial guarantees (e.g., guarantees for the coverage/protective layer of metal tiles). The conditions, duration, and extent of the commercial guarantee are indicated in the manufacturer's warranty certificate accompanying the product. The commercial guarantee does not affect or limit the Consumer's rights resulting from the legal guarantee of conformity.

10. Complaints

10.1. Complaints are submitted to the contact details indicated in section 1 (in writing, by e-mail, or at the workplace), with a description of the lack of conformity and attachment of proof of purchase.

10.2. The Seller examines and resolves the complaint within no more than 14 calendar days from the date of submission (Art. 9 of Law no. 105/2003).

10.3. In case of a disagreement regarding the cause of the defects, the Consumer's fault can only be established through technical expertise carried out under the conditions of the law (Art. 25 of Law no. 105/2003).

12. Supervisory Authority and Consumer Protection

12.1. The authority responsible for consumer protection is the State Inspectorate for Supervision of Non-Food Products and Consumer Protection (ISSPNPC):

13. Dispute Resolution

13.1. The parties will attempt to resolve any dispute amicably, by the Buyer addressing the Seller at the contact details in section 1.

13.2. The Consumer may resort to alternative dispute resolution (ADR) mechanisms, including by addressing the ISSPNPC, as well as mediation under the conditions of the legislation of the Republic of Moldova.

13.3. Disputes not resolved amicably are under the jurisdiction of the courts of the Republic of Moldova, according to the law. No provision of these Terms limits the Consumer's rights to address the court at their domicile, in cases provided by law.

14. Applicable Law and Language of the Contract

14.1. These Terms and Conditions and contracts concluded through the site are governed by the legislation of the Republic of Moldova.

14.2. The contract is concluded in Romanian. In case the site or contractual documents are available in other languages, the Romanian version prevails.

15. Final Provisions

15.1. The Seller may modify these Terms and Conditions. The version applicable to an order is the one in force at the time of order placement. The updated version, with its number and date, is published on this page.

15.2. If a provision of these Terms is declared void, the other provisions remain valid.
